Welcome to the Candies Heaven website and mobile app (collectively referred to as the "Websites and Apps"). This page, along with the documents referenced on it, outlines the terms and conditions under which Candies Heaven will supply any of the products listed on the Websites and Apps (the "Products") to you. Before ordering any Products from the Websites and Apps, please carefully read these terms and conditions. By accessing the Websites and Apps and placing an order, or by visiting a store and placing an order, you agree to be bound by these terms and conditions and the terms of use policy outlined on the Websites and Apps.

If you have any questions about these terms and conditions, please submit a support ticket in the Candies Heaven portal before placing your order.

If you do not accept these terms and conditions, please exit the Websites and Apps and do not place an order.

This website is intended for retail customers only. "We reserve the right to cancel and refund orders that we believe may be for the purpose of reselling in large quantities, and not for personal use

 

 

Summer heat damage:

While high temperatures can affect all food products to some extent, most types of candy are fairly stable and resistant to melting. However, certain types of candy, such as chocolate, caramels, marshmallows, and gummies, may be more susceptible to melting. While we cannot guarantee that heat-sensitive candies will arrive in perfect condition due to factors such as weather and delivery conditions, the majority of orders are not affected by heat. However, during the hottest times of the year, it may be advisable to avoid placing orders for these types of candy. While we can assure you that the products will not leave our warehouse in a melted state, we cannot guarantee that they will not melt during transportation or storage in a hot delivery vehicle, sorting office, or on a hot doorstep. Melted candy is not considered 

Returned orders:

If a customer is unable to receive their package on the delivery date or fails to make arrangements for the package to be redelivered or collected within the time frame specified by the courier, the package will be returned to the sender. In this case, the customer will be responsible for paying the initial delivery charge, as well as any fees charged by the courier for returning the package. Once the package has been returned to the sender, the customer will be offered the option to either receive a refund for their order, minus the initial delivery charge and any return fees, or to have the order re-dispatched at an additional cost that includes the delivery charge and any return fees.

 

Privacy

The use of your personal information is covered by the American Sweets Privacy Policy, listed at the bottom of our website.

Purpose

"The goal of the Websites and Apps is to provide an easy and convenient service for our customers to browse and place orders online.

Your status

When you place an order through the Websites and Apps, you declare that you are legally able to enter into binding contracts.

Our status

The Websites and Apps may contain links to the websites of other companies, whether they are affiliated with us or not. We cannot guarantee that products purchased from third party sellers through the Websites and Apps, or from companies whose websites are linked on the Websites and Apps, will be of satisfactory quality. Candies Heaven does not offer any warranties for these products, and this disclaimer does not affect your legal rights against the third party seller.

Availability and Delivery

Our goal is to offer the best delivery service in the market, which includes a track record of timely delivery. However, sometimes things don't go as planned and external factors, such as weather and traffic, may prevent us from achieving this.

We will strive to fulfil your order according to the delivery date and time specified in the confirmation email, or within a reasonable timeframe from when the confirmation email was sent, taking into account the volume of orders and any challenges Candies Heaven may be facing at the time

Cancellation

Information about cancellations, returns, and refunds can be found in our Returns Policy, which is listed at the bottom of the website.

 

Price and Payment

The price of any Products will be as listed on our Websites and Apps, and may vary from time to time, except in cases of obvious error. Prices include VAT.

Prices are subject to change at any time, but changes will not affect orders that you have already paid for or where you have already completed the check-out process and been presented with the Confirmation Screen in an online order (unless, due to a technical error, you have been overcharged or undercharged for some reason). Despite our best efforts, some of the Products listed on our Websites and Apps may be incorrectly priced (either due to human or technical error).

Payment for all Products can be made by credit or debit card at the time of ordering or through PayPal. We accept payment via Maestro, Visa Delta, Visa, and MasterCard. Valid vouchers may be applied to your order before payment. You may not use more than 1 voucher per transaction. We will charge your credit or debit card at the time of order.

If you choose to pay by credit or debit card through the Websites and Apps, your credit or debit card will be authorised and the amount marked for payment once your order has been confirmed. 

Our liability 

If Candies Heaven fails to meet the terms and conditions of this agreement, we will be liable for any foreseeable loss or damage you experience as a result of our breach of these terms or our negligence, up to the amount you paid for the Products you ordered. However, we will not be responsible for any loss or damage that could not have been anticipated at the time of your purchase. Loss or damage is foreseeable if it was a likely outcome of our breach or if it was considered by both of us at the time of your purchase from the Websites and Apps.

We only provide the Products for personal, domestic, and business use. You agree not to use any Product for commercial or resale purposes, and we will not be liable for any loss of profit, business interruption, or loss of business opportunity that may result from your use of the Products.

Termination 

We reserve the right to decline a new registration, terminate your right to link to the Websites and Apps under these terms and conditions. If we consider there to be a risk of liability or loss to us or Candies Heaven we may take any action deemed necessary to prevent such a liability or loss from occurring. Candies Heaven may also, in certain circumstances, ask you not to return to its Store and/or place any further orders.

 

If we terminate your right to link to the Websites and Apps you must cease linking to the Websites and Apps immediately. We reserve the right to assign or sub-contract any or all of our rights and obligations under these terms

 

Written Confirmation

According to relevant laws, some of the information or communications we send to you must be in written form. By using the Websites and Apps, you agree to communicate with us electronically. We will communicate with you through email or by posting notices on the Websites and Apps. For the purpose of entering into contracts, you agree to this form of electronic communication and acknowledge that all contracts, notices, information, and other communications we provide to you electronically meet the legal requirement for written communication. This provision does not impact your legal rights.

 

Events outside our control

We will not be held accountable for any failure to fulfil or delay in fulfilling our obligations under a contract that is caused by circumstances beyond our control (referred to as a "Force Majeure Event").

A Force Majeure Event includes any act, event, non-occurrence, omission, or accident beyond our control, such as:

a.) strikes, lockouts, or other industrial action;

b.) civil unrest, riots, invasions, terrorist attacks or threats of terrorist attacks, war (whether declared or not) or threats or preparations for war;

c.) fires, explosions, storms, floods, earthquakes, subsidence, epidemics, or other natural disasters;

d.) the inability to use railways, shipping, aircraft, motor transport, or other means of public or private transportation;

e.) the inability to use public or private telecommunications networks;

f.) the actions, decrees, legislation, regulations, or restrictions of any government; or

g.) non-performance by suppliers or subcontractors.

Waiver 

"If Candies Heaven does not enforce its rights or remedies under a contract or these terms and conditions, or if it fails to require strict compliance with any of your obligations under the contract, this does not mean that it has waived those rights or remedies. Additionally, a waiver of a default by Candies Heaven does not waive any future defaults. Any waiver by Candies Heaven of these terms and conditions must be explicitly stated in writing (email communication is acceptable) in order to be effective.

Severability 

If a competent authority determines that any of these terms and conditions or any provisions of a contract are invalid, unlawful, or unenforceable, then that term, condition, or provision will be separated from the remaining terms, conditions, and provisions, which will continue to be valid and enforceable to the fullest extent permitted by law.

Entire Agreement 

These terms and conditions, along with any documents specifically mentioned in them, constitute the entire agreement regarding the subject of any contract and replace any previous agreements, understandings, or arrangements, whether verbal or written. Both parties acknowledge that in entering into a contract, they have not relied on any representations, commitments, or promises made by the other party or implied from anything said or written during negotiations before the contract, except as specifically stated in these terms and conditions. Neither party shall have any recourse for any false statements made by the other party, whether orally or in writing, prior to the date of any contract (unless such false statement was made fraudulently), and the other party's only recourse shall be for breach of contract as provided in these terms and conditions.

Our right to alter these terms and conditions

Candies Heaven reserves the right to revise and amend these terms and conditions periodically. Any changes we make to these terms and conditions will be posted on this page. You will be bound by the policies and terms and conditions in effect at the time you order products from Candies Heaven, unless any changes to those policies or these terms and conditions are required by law or governmental authority.

Third Party Rights

Only the parties to these terms and conditions have the right to enforce any of its terms and conditions. No other person or entity has this right.

 

Law and jurisdiction

Contracts for the purchase of Products through our site and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) will be governed by English law. Any dispute or claim arising out of or in connection with such contracts or their formation (including non-contractual disputes or claims) shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.
